Our contract

We must receive payment of the whole of the price for the goods you order before your order can be accepted. Our acceptance of your order brings into existence a legally binding contract between us. Acceptance shall occur on either the debiting of your credit/debit card or the clearance of funds made direct into our bank account.

Price & Payment

The prices payable for the goods you order are as set out on our website and are inclusive of VAT. You have the option to purchase online using Sage Pay via our secure server or by contacting us on 01603 458916 to arrange payment by bank transfer or cheque. All payments are made to Bartram Mowers Limited.

Returns

You must report any shortages or breakages within 24 hours of their receipt by emailing sales@lawnmowers-direct.co.uk. This is so we can claim back costs via the relevant carrier. Failure to contact us within 24 hours may result in you be liable for the full cost of the goods. We will contact you within 72 hours to arrange for a courier to collect the goods. All refunds are made within 21 days.

Cancellation

You have the right to cancel your order. The Cancellation Period begins from the day on which the goods are delivered. The Cancellation Period ends 14 working days after the goods are received. All cancellations must be made in writing to sales@lawnmowers-direct.co.uk. Goods must be returned in an unused state, and in their original packaging. We will return your money within 21 days of notice of cancellation. Non-faulty goods that are returned will be subject to a 10% re-stocking fee. Return postage and insurance charges for non-faulty returns must be borne by the customer. This does not affect any statutory rights of the consumer.

Availability of Goods

Whilst we endeavour to hold sufficient stock to meet all our orders we cannot be held responsible or offer any compensation for any disappointment endured if we fail to meet our designated delivery time. All orders are subject to availability.

If we are unable to deliver within our specified time we will contact you to inform you. Will try to arrange a alternative time that is suitable to you. If this is not acceptable, you have the option to cancel your order, and you will receive a full refund.

Delivery

We will deliver the goods ordered by you as soon as reasonably practicable to the UK address you give us for delivery at the time you make your order. A valid signature is required on delivery. You will become the owner of the goods you have ordered on delivery of them to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

Product Descriptions

The product details on this site have been written by us, to help you the consumer choose between models, these are solely the opinion of Bartram Mowers. All the specifications and images are true to the best of our knowledge. We cannot be held responsible for any errors to product details. Products prices are continually updated and so this site maybe changed without prior notice.

Force Majeure

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).

Invalidity

If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected.

Governing Law

The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have exclusive jurisdiction to resolve any disputes between us.

Entire Agreement

These terms and conditions, together with our current website prices, delivery details and contact details, set out the whole of our agreement relating to the supply of the goods to you by us. These terms and conditions cannot be varied except in writing, signed by one of our directors. In particular nothing said by any of our staff should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. We shall have no liability for any such representation being untrue or misleading.

Manufacturers Guarantees

All products we sell come with manufacturers warranty.

In the unlikely event that the goods that you purchase from us develops a fault within the warranty period, Bartram Mowers will refer you to your local dealership where the product will be examined by their qualified technicians and repaired as per the warranty details.

Bartram Mowers will not be liable for any additional costs incurred whilst goods are away for warranty repairs.

Waste Electrical and Electronic Equipment Regulation 2006

The Waste Electrical and Electronic Equipment (WEEE) directive is now UK law and came into effect on the 1st July 2007. The legislation aims to make producers pay for the disposal of waste electronic equipment. WEEE can have a harmful effect on natural habitat, wildlife and also human health and the disposal of WEEE should be completed in the correct way to minimise the effects on our environment.

All WEEE goods should be marked with a crossed out wheelie bin symbol to show that they were produced after 13th August 2005 and should be disposed of separately from normal household waste so that they can be recycled.

Bartram Mowers Limited is a member of the Distributor Take Back Scheme (DTS) and one of the duties as a membership is to advise our customers as to the availability of their local Designated Collection Facility (DCF). LAWNMOWERS DIRECT reserves the right at any time to revise its prices or the details given on this site without notice. All orders for products are subject to availability and LAWNMOWERS DIRECT reserve the right to refuse to supply to any individual or company for whatever reason.

CREDIT CARD

LAWNMOWERS DIRECT uses a secure server to protect your credit card information and assist your shopping experience. However, any losses incurred or sustained by customers who transmit information by means of email or other Internet link shall be borne solely and exclusively by that customer and in no event shall any such losses in whole or in part be borne by LAWNMOWERS DIRECT. When using a public computer, you must sign out when you have finished shopping.

If you discover that goods have been ordered using your credit card by someone not authorised to do so, LAWNMOWERS DIRECT, will refund to you the money it receives provided that: (a) you inform your credit card company and LAWNMOWERS DIRECT of unauthorised purchase as soon as you discover it; (b) you cooperate with your credit card company, LAWNMOWERS DIRECT and, if necessary, the police in relation to the unauthorised use and (c) we have not already dispatched the goods in question to the person or company who actually ordered the goods.
